Have you been advised by a well-meaning friend or relative that the listing agent will do their best to get you an accepted offer because it is to their advantage since they will get a higher commission, or they might even offer the seller a lower fee to encourage your offer be accepted over any others? Have you considered that the listing agent already has an allegiance to the seller, and that he must make ever y effort to get the best price and terms for the seller? Since he is required by California law to be a fiduciary to the seller, are you willing to trust that you will be dealt with equally as well? Also, if you do succeed in getting your offer accepted, how effective do you imagine the agent might be in arguing on your behalf once you have obtained building inspection results? Moreover, do you think the agent is likely to recommend as many inspections to be done, and using more thorough inspectors, if they are also the seller's agent? e definition of a "fiduciary" comes from the word "trust". It refers to anyone who holds something in trust – like a trustee. e word "trust" includes a reliance on the integrity of another person, or placing confidence in someone else. A "fiduciar y " has to educate and interpret on behalf of their client. A "fiduciary" would advise and consult about possible consequences and results of various different courses of actions. A "fiduciary" agent is one who helps guide their clients to different service providers and recommends courses of action that may be of the greatest benefit to their client, be it as a buyer or seller. The "fiduciary" agent is therefore far more involved in a consultant role. Why would you not want such an agent to be in your corner? e following is an example of how a "fiduciary" responsibility could occur regarding an agent's relationship with a buyer. If the buyer has begun negotiating the purchase of a home and a new listing comes on the market that may better serve his needs, a "fiduciary" will inform the client of the new opportunity, even though that could result in starting the purchase process all over again. Someone who is planning to sell or buy real estate might include a question about "fiduciar y " in the process of inter viewing agents. They could ask what each prospective agent thinks about the issues involved and ask for some examples of how they might demonstrate a "fiduciary" level of service. A "fiduciary" will always place the client's interests above the interests of all other parties – including the agent's own interest.
